Please read the following terms and conditions carefully. These terms and conditions apply to anyone starting a course with Marshallsay English. These terms and conditions are a contract between you (trainee) and Marshallsay English.
All online courses are provided by Marshallsay English, Henry Budge Strasse 53, 60320 Frankfurt am Main, Germany.
This website is owned and operated by Marshallsay English.
Marshallsay English may change the content, which includes prices, offers and content at any time. We do not provide a warranty or guarantee of its accuracy, completeness, suitability, timeliness or performance of information or content in the website. If there are errors in the information provided in the content of the website, we expressly exclude liability for these inaccuracies to the fullest extent that the law permits.
You can use any of the information or content at your own risk for which Marshallsay English will not be liable. It will be your responsibility to ensure that any products you purchase are suitable for your current requirements.
All materials, which include copy, content, layout, and design belong to Marshallsay English.

All of the online courses on the website and brochure are provided by Marshallsay English and are subject to the following conditions:
- Course Requirements:
1.1 All of the courses provided in English. All customers must have a competent native level of English and possess a reasonable competence in English language reading, writing and speaking skills.
1.2 All candidates enrolled in an interactive course must have the ability to take advice from the tutor and have the capability to make improvements to their result if required.
1.3 By making a booking with Marshallsay English it is assumed that the candidate satisfies the above conditions and is deemed to have a competent level of English. The candidate, by making a booking, takes full responsibility in determining whether the course is suitable for their level of English. Marshallsay English takes no responsibility if the candidate is unable to complete and pass the course.
1.4 Marshallsay English does not accept any liability for any losses, costs or expenses incurred by or on behalf of a candidate in connection with a candidate’s insufficient language ability.
- Booking a course
2.1 Booking can be made online on our website http://www.marshallsayenglish.com. The person making the booking must be at least 18 years old and by paying for the course accepts the terms and conditions. Marshallsay English states that by paying for a course you have read the terms and conditions. You are also responsible for the accuracy of your personal details. Marshallsay English will only deal with you in the event of cancellations or disputes.
2.2 You must make full payment at the time of booking. Marshallsay English does not accept deposit or partial payments or installment payments.
- Price of Courses
3.1 All prices advertised on our website are correct at the time of booking. However, Marshallsay English reserves the right and discretion to change our prices at any time. Please check our website for up-to-date prices and special offers before you book.
- Changing or cancelling a course
4.1 Cooling-off Period
Under EU consumer legislation you have the legal right to cancel your course up to 14 days from date of purchase, as long as you have not started the course. This is known as the “cooling-off period.” If you decide to cancel the course within this cooling-off period, you must inform us within the 14 days of payment by email to email@example.com.
Once we receive your written cancellation, in the form of an email we will refund your course fees within 30 days.
Once the 14 days are over, the course fees are non-refundable.
Once you login to the course for the first time, you will be deemed to have started the course and will no longer be able to get a full refund, even if it within the 14-day period.
Once you have cancelled you booking your login details will be cancelled immediately.
- Passing the course
5.1 Purchasing a course does not automatically guarantee that you will pass the course. If you fail to meet the requirements of passing a course then Marshallsay English reserves the right to fail you.
5.2 You will be given unlimited attempts to pass each of the quizzes. You must achieve a pass rate of 80% for the online portion of the course.
5.3 If you have chosen one of the interactive packages, there is no pass or fail, just improvement.
6.1 Every student who passes the online portion of the course will receive a PDF certificate from Marshallsay English by email.
6.2 If you would like to receive a hard copy of your certificate then there is a charge of €5.00 for EU and €7.00 for outside of the EU. Marshallsay English will do everything possible to make sure that you receive your certificate within 30 days of passing the course. However, we do not take any responsibility for any postal service problems, which might delay your certificate and we do not take responsibility for a lost certificate due to in-country postal problems. We can provide proof that the Certificate was sent to your confirmed postal address. This covers all geographic locations.
- System Maintenance and Upgrades
7.1 At certain times our systems and software programs will be updated. In the event of an update will we endeavour to do this work as quickly as possible. However, if our systems are not working for a period longer than 72 hours then will allow our candidates to extend their course for no more than 72 hours.
7.2 It should be noted that no refund will be given for the unavailability of the website lasting up to 72 hours.
- Limitation of Liability
8.1 Marshallsay English does not accept any liability for any loss or additional expense caused by delay or disruption to travel services, weather conditions, civil disturbance, industrial action, strikes, wars, floods, sickness or force majeure. Such losses or additional expenses are your responsibility. Force majeure represents unusual or unforeseeable circumstances, which include: war, terrorist activities, riots, natural or other disasters such as fire, flood or adverse weather conditions.
9.1 If at any time, you are unhappy with the service at Marshallsay English, please contact us immediately at firstname.lastname@example.org and we will respond as quickly as possible but no more than 30 days following the receipt of your complaint.
- Accuracy of Marketing Materials
10.1 Marshallsay English makes every effort to ensure the marketing materials on our website are up to date and accurate. We take no responsibility for any information that is deemed incorrect and we will endeavour to do our best to inform you of any changes to the course. We reserve the right to change any of the information on our website at any time we feel appropriate.
- Third-Party Rights
11.1 A person that has no connection to the course shall have no rights in the contract.
- Changes to Terms and Conditions:
12.1 Marshallsay English reserves the right to change any of these conditions at any time deemed necessary to reflect current market and economic conditions.
13.1 If any party finds any of the terms and conditions in this document to be deemed illegal, invalid or unenforceable then these parts will be deleted while the other parts of the terms and conditions will be deemed valid.
